Buying without UKARA
29 May, 2014, 09:09
Hey
I want to buy a black rifle from this forums classified section but I don't have a UKARA licence
However I am a regular airsofter
Is that a valid defence or do I HAVE to have a UKARA to buy a black gun?

Re: Buying without UKARA
No such thing as a UKARA 'license.'
In order for someone to sell a RIF to you they need to create a defence against prosecution for themselves. You can provide this defence for them by showing them that you are over 18 and somehow assuring them that you intend to use the RIF for airsoft at a site with third party liability insurance. Being on the UKARA database is the easiest way to do this, but is not the only way. If you could show the seller that you have membership to a site, which they could then confirm, they may chose to accept that as forming their defence, but it's up to them since they're the one who is breaking the law and could potentially end up in trouble.

Re: Buying without UKARA
If you're a regular airsofter then you probably visit at least 1 site fairly regular? Are you know there? If so, put the seller in contact with the site.

Re: Buying without UKARA
Strange, in another thread you were wanting to sell a "black rifle" because you do not have a "licence" for it.

Re: Buying without UKARA
So we went from
"Hey

To
"This was just for info for future reference"
I certainly hope you didnt contact the seller of this 'black rifle in the forums classifieds', otherwise he may get pretty pissy at waiting for a sale sometime in the ' future'.

Re: Buying without UKARA
Anyway
On my other thread the fact that it was black was one of the reasons, not the only reason
I just want to get a better gun and didn't know if I was going to have any problems selling it
I then just wanted to know if there was anyway I could buy a black gun without becoming a member at any site and not being in the UKARA database
But I see that there isn't really any way for me to do that

Re: Buying without UKARA
Someone who is on the database or who has a defence can buy it and give it to you as a gift.

Re: Buying without UKARA
You do not need to become a 'member' of a site, they just need to be willing to vouch for the fact that you are a regular skirmisher. Unless you play at many different sites, your regular site should have a log of your attendance, and therefore should be willing to back you. As Fizzy said, just give the seller the contact details so they can confirm you play there.

If only there was somewhere you could check the law.....
I don't know, maybe... The violent crimes reduction act maybe.
http://www.legislation.gov.uk/ukpga/2006/38/section/36
Read through up to and including section 41. Remember, UKARA registration is only ONE of several ways to prove a defence.

Re: Buying without UKARA
^ The problem there is that the defence which is applicable to airsoft doesn't feature in the VCRA.
