Advice on Swap

I recently did a swap my pistol plus cash for a TM M9 TacMaster.
The pistol arrived rapidly but, there is an issue with the pistol. I've never seen this before or heard of the issue and have searched the forum and googled it. The hammer is pushing too far into the mag well so mags wont slide in if the pistol isnt cocked. Once cocked and mag in the gun fires off well enough but if the hammer is released it just releases all the gas out of the mag.
The seller has been really good up to now and has replied to me stating that he thought this was a common fault on the pistol and thought thats how they were standard?
Is there an easy fix for this and what would you advise (reclaim some cash to make the pistol work correctly as isnt as described) or just accept it as an honest mistake?

Sounds a bit fishy to me buddy, id try and get it fixed and get him to pay the costs.
