In need of a second opinion

Didnt know the best place to post this so it ended up here. I swapped guns with another member of this site recently, my M249 for his M4 S-System, this being the first M4 type weapon i had owned, strange i know. The trader failed to mention many faults with his weapon including missing RIS rails and a screw in the base of the pistol grip necessary to hold the motor in position, however i was unfamiliar with the necessity of this screw. After skirmishing with it the following day the gun failed to fire after less than 1000 rounds through it, upon inspection by one of the site marshalls it was discovered that this was due to damage to the motor caused by the lack of this screw. I really don't know where i stand with this as it could be argued my actions caused the damage, though i feel i was sold an incomplete weapon. I would just like to hear what some other people think of this situation

First things first,
Have you spoken to the guy who sold you the M4? You should try this first and find out if he new there were parts missing from the gun. Then you can discuss with him what to do next. If he denies any problems or wont talk to you then first course would be to talk to a mod and see if a friendly pm from them can help resolve the matter.
Try this first then let us know.

Have you contacted the guy you got it off and let him know about the issues? That would be the first thing I'd do. I'd also look in the box to make sure the screw simply hadn't fallen out in transit

Speak to the guy first. it may get resolved amicably. If not there was another thread on here a couple of days ago.
Provided you have kept all communications you may be able to claim back trough the sales of goods act find the other Thread and read up on that is should help you.

The big problem I can see here though, is that regardless of the missing parts you still used it. Obviously if you didn't know about the screw in the base that is different but the cosmetics are. If it had been me selling (although i wouldnt sell a gun in that condition without stating to that effect) you will have given me a get out clause,

Yes i've spoken to the trader, it was actually him that pointed out that the screw was missing but he didnt tell me this before we traded and as i said as i haven't owned an M4 model before i didnt realise that this was necessary. The trader has said that it was my fault and actually asked if i had been "jumping around or running with the gun as that may have caused it to break as its missing the screw" i myself haven't been to a skirmish in which you dont run, though i didnt jump around (its not counter strike after all). Am i to assume a PM to the mods would be the best course of action then as i feel that there is unlikely to be any amicable resolution with this trader.

That would be a start, but as far as I am aware they have no power to force a refund. The best they can do is mediate and/or list the person as a bad seller for future buyers

IMO the fairest thing to do is either ask to trade back (As he shouldn't of swapped a non working gun for yours without first making sure you fully understood the faults) or ask him to supply the replacement parts as it is obvious if you explained to him that this was your first v2 gearbox style AEG that you were not to know about the motor adjustment screw or its significance to the function of the AEG.
If he tries to say you shouldn't of used it IMO if he hasn't blatantly pointed it out he is at fault for not doing so.

This is exactly what i have said to him, i guess i'll have to wait for The Keeper of Secrets to speak with him and try to mediate a little with this.
