actually as the charger hasnt arrived,then the sale is in fact incomplete, and the gun has not been test fired yet,but is it too late to open a paypal dispute,because it sounds like the seller is being very slack,what with delaying posting important items and selling clearly broken guns imo

Even so, I would always check everything about a gun as soon as it arrives. Then let him know in a day or so after receiving and checking it. Don't give the guy time to say you must've used it.
If he does sort it, like the guy said above, fair play to him. But if he doesn't then it is a lesson learned.
A gearbox case will be a cheap enough fix though so not the end of the world. And if it is a TM G3 then they are decent enough guns to do the fix to.

thats true...but only if you have experience with swapping over mech boxe cases...my first couple of time was a disaster just changing springs,and a sharpe learning curve

its my first airsoft gun so taking it apart and checking everything wasnt really an option. but i agree, its looking like a lesson hard learned. glad the gearbox case isnt too expensive though! thanks again

Had it happen to me and where the body held the casing together it wasnt that noticable, It may have cracked in the post etc...
Or he may not have tested it before sending it out (should have) but may not have.
Was just stating the seller may honestly not have known in which case he should let him know asap.

You should expect at least a £25 refund I would have thought.
And I don't understand? Who has decided that 3 weeks is the cut-off. I would understand if it was 6 months but why would you let a guy get away with selling someone that, just because it's been 3 weeks?
Paypal have 40 days, and people often moan that that's not long enough.
Unless ofcourse the damaged could have occurred whilst the OP owned it.

Generally you only get 28 days with purchased goods, and from Mid April to the second week in June is longer than 3 weeks :p

Where do you buy things from? I've taken goods back after months and got refunds/replacements. The assistant in Aldi tried to tell me I had to deal with the manufacturer on an MP4 player a couple of weeks ago, because it was over 30 days. I pointed out to the manager that my contract was with them and not with the manufacturer and I got a refund on the spot. Things are a little different with second hand sales, but not by very much.
Sale of goods act doesn't specify any period, it just uses the phrases reasonable/merchantable quality and fit for purpose.
It all depends on price. If the OP paid £50, then what does he expect. If he paid £350, then it would be expected to last for months.

Actually, I've worked for a couple of retailers, and on their sales receipts it basically says no refunds/returns after 28 days. They may do store credit after that.

someone might correct me on this, but a reciept statement means squat ... doesn't precede the law, same as a website based in the uk saying we don't do refunds ...
a lot of shops do it to deter people from requesting in my opinion ...
that looks pretty banjaxed ( I'd expect major airseal problems there, just lucky the O-ring looks good and thick!

Hmmm the law vs some small print on a receipt :D
Firstly, goods have to be fit for purpose and free of defects. Secondly, a receipt is given after a sale. The terms of business need to be agreed prior to a sale.
Therefore you can write what you like on the back of a receipt, but it's too late to be upheld!
If I was to be really boring I'd dig out the caselaw for this. It involved some deckchairs.... lol.

I can beat you on that mate, I've still got my copy of the CCJ I obtained against a supermarket for refusing to replace a DVD player that went faulty after 6 months. The player cost me £60 and I got a refund plus £153 costs and damages!
EDIT: Don't forget the phrase (something along the lines of) "The refund policy does not effect your statutory rights."

I have been in retail for over 20 years and there is a huge difference between what stores will do as a "gesture of goodwill" to keep you happy and what they are legally obliged to do.
The important thing here is what are we saying ? How long are sellers on this forum responsible for items thay have sold ? If I buy a second hand gun from this forum, use it for two or three games, putting say 5000 rounds through it, over a three week period, then it strips a gear is this the sellers fault.
On the other hand why should you have to do an internal gearbox inspection on something you have just forked out on ? Clearly misold items and stuff delivered visibly broken is a sllightly different matter.
It is an awkward situation and one that in fairness has many grey areas and can be difficult to sort out. As mentioned earlier we had a thread recently from a sellers perspective and many supported that seller as some time had passed between the receipt of goods and the complaint being raised.
Should we issue some sort of guideline for both seller and buyer regarding issues with items and viable time spans for complaints. Should second hand items be made to come with the same gurantee as new ?
